Auction Terms & Conditions TERMS AND CONDITIONS Location: Dripping Springs ATX Auctions There will be a 16% Buyer's Premium Added to All Buyer's Totals for Each Item Purchased. ALL SALES ARE FINAL EVERYTHING IS SOLD AS IS NO GUARANTEES OF OPERABILITY NO WARRANTIES, EXPRESSED OR IMPLIED BUYERS ARE TO RELY SOLEY ON THEIR OWN INSPECTION AND INFORMATION Removal: (NO APPOINTMENT NECESSARY) Pickup is scheduled Friday and Saturday January 20 and January 21st from 10am-5pm CT. For everyones safety during pickup please remain outside the warehouse beyond the roped off area. Upon arrival please call 512 923 1899, we will then pull your invoice and have the warehouse staff begin picking your items or provide directions for payment. When the warehouse staff are finished picking your items we will bring them to you. Loading your items is your responsibility. FOR EVERYONES SAFETY Please do not congregate in the warehouse doors or office but wait outside at your vehicle. Thank you for your cooperation. Appointments must be scheduled with the auctioneer if your unable to pickup during the schedule days and time. For example: If an auction closes on Wednesday, the removal days are Friday and Saturday or the buyer must schedule a pickup appointment with the auctioneer, (auctioneers discretion) for the following week. We will begin charging $10.00 per day storage fee if items are not picked up 14 days after auction closing. After 30 days we will charge an additional warehouse storage fee of $45.00. There will be no refunds for merchandise not removed by the deadline date and will be considered abandoned and disposed of or resold by ATX Auctions. Buyer accepts responsibility for ensuring pickup in a timely manner. The Auctioneer in addition to all other remedies allowed by law, may retain all monies received as deposit or otherwise, as liquidated damages. All descriptions and information are offered only as a guidline. All merchandise is sold As-Is and Where Is without warranties or guarantees of any kind. ATX Auctions Dripping Springs does not represent any manufacturer or retailer. By request we will do an additional inspection of the item that you have interest bidding on, however, that inspection is only our opinion and does not imply a warranty or change the fact that all items are being sold in as is condition. Articles purchased may not incorporate approved activating mechanisms, operating safety devices or safety guards as required by OSHA or otherwise. It is the Purchaser's responsibility that articles purchased be so equipped and safequarded to meet OSHA and any other requirements before placing such articles into operation. Purchaser agreees to indemnify and hold Auctioneer harmless from and against all claims and liabilities relating to the condition or use of the articles purchased or failure of user to follow instructions, warnings or recommendations of the manufacturer, or to comply with federal, state and local laws applicable to such articles, including OSHA requirements, or for proximate or consequential damages, costs or legal expenses arising therefrom. All Bidders are required to be ID verified to bid by registering with a valid credit or debit card. All Bidders are responsible to know what item they are bidding on. The winning bidder of any item ENTERS INTO A LEGALLY BINDING CONTRACT and is expected to pay for all "won" items, even if the bidding was done in error. You must be at least 18 years old or older to bid in any of our auctions. There are no exceptions to this. If you are under the age of 18 and place a bid in one of our auctions you are violating state law and may be held accountable for this. *Payment Types: Cash/Visa/Mastercard/Discover/American Express, Wire Transfer. *PAYMENT TERMS: AT THE CLOSE OF OUR AUCTION YOUR REGISTERED CREDIT CARD WILL BE AUTOMATICALLY CHARGED TO PAY YOUR INVOICE. AFTER THE AUCTION CLOSES YOU WILL RECEIVE AN EMAIL FROM AUCTION FLEX WITH A LINK TO DOWNLOAD A COPY OF YOUR PAID RECEIPT. IF YOU DO NOT RECEIVE AN EMAIL AFTER OUR AUCTION CLOSES PLEASE CHECK YOUR SPAM FOLDER AND CONTACT US AND WE WILL RESEND YOUR RECEIPT IF YOU ARE A TAX EXEMPT BUYER PLEASE NOTIFY US BEFORE THE AUCTION CLOSES, "A NOTE TO AUCTIONEER" OR CALL, PROVIDE US A COPY OF YOUR TAX EXCEMPT CERTIFICATE, WE WILL THAN REMOVE THE SALES TAX, ADD YOUR TAX CERTIFICATE NUMBER TO OUR DATABASE AND RESEND THE ADJUSTED INVOICE FOR PAYMENT. All Buyers must have a paid receipt from ATX Auctions at time of pickup. We encourage you to save time at pickup, follow the link sent to your registered email account with your invoice, (check your junk or spam folder) print your paid receipt and bring it with you or Buyers making payment at the time of pick up will be issued a receipt at that time.
